Fhwa Section 106 Programmatic Agreement
What is it? “Programming Agreements” (PAs) are contracts defining how agency programs are implemented. CONSIDERING that the Delaware Nation and the Delaware Tribe have commented on the draft agreement and that the FHWA has asked them to approve the agreement; and CONSIDERING that, in accordance with the consultation conducted pursuant to 36 CFR 800.14 (b), the Signatories have developed this Programmatic Agreement (Agreement) in order to create an effective, efficient and streamlined alternative, to take into account the impact of the Program on Iowa`s historic concessions and to provide ACHP with an appropriate opportunity to carry out projects under this Agreement, to take a stand; and any signatory to the PA may terminate it by making available to the other parties a period of thirty calendar days in writing, provided that the parties consult during the period preceding the denunciation in order to reach agreement on modifications and other measures that would avoid termination. . . .
